Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Kovex, including the website, dashboard, agent software, and related services (the “Service”), operated by Kovex LLC, a New Mexico limited liability company (“Kovex,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Kovex provides tools to help you manage Old School RuneScape accounts, including account organization, agent software for launching and monitoring clients on machines you control, proxy management, automation features, account checking, and related dashboard capabilities. Features available to you depend on your plan and account status.

• You must be at least 18 years old.
• You must authenticate with a valid Discord account and comply with Discord’s terms.
• You are responsible for all activity under your Kovex account and for safeguarding access to your Discord account, two-factor authentication, and agent connections.
• You must not share agent access or account credentials in a way that allows unauthorized use of the Service.
• You are responsible for ensuring your use of the Service is lawful in your jurisdiction.

You agree not to:

• Use the Service to harass, defraud, scam, or harm others.
• Attempt to reverse-engineer, decompile, tamper with, or circumvent security or access controls of the Service, except to the limited extent such restriction is prohibited by law.
• Probe, scan, or test vulnerabilities except through responsible disclosure to us.
• Resell, sublicense, or redistribute access to the Service without our prior written consent.
• Interfere with or disrupt the Service or other users’ use of it.
• Use the Service in violation of applicable law or third-party terms that apply to you.
• Misrepresent your identity or affiliation, or attempt to evade a suspension or ban.

• You are solely responsible for the game accounts and credentials you store or manage through the Service.
• Credentials are encrypted at rest, but you accept the inherent risks of storing sensitive information with a third-party service.
• We are not responsible for game account bans, restrictions, losses, or actions taken by Jagex or any other third party.
• You represent that you have the right to use any accounts, proxies, and machines you connect to the Service.

• The Kovex agent runs on devices you control and communicates with Kovex over encrypted connections.
• You are responsible for installing, configuring, and securing the agent on authorized machines only.
• The agent may download components required for features you use (for example, telemetry).
• Updates may be offered through the agent; you control when to apply them unless we notify you otherwise for critical security fixes.

• Free and paid plans may be offered with different features and limits, as described in the Service.
• Paid plans may be purchased with the payment methods we make available (for example, card via Stripe, cryptocurrency, or other methods we list at checkout).
• Subscriptions activate when payment is confirmed according to the method used.
• Unless stated otherwise at purchase, monthly plans do not auto-renew; lifetime plans do not expire once activated, subject to these Terms.
• Refunds. Cryptocurrency and similar irreversible payments are final once confirmed. Card refunds, if any, are considered case-by-case and may be limited when Service features have already been used. Contact Support promptly if you believe a charge was made in error.

The Service, including software, branding, and content we provide, is owned by Kovex LLC and its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose in accordance with these Terms. You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted.

The Service integrates with third parties such as Discord, payment processors, and game platforms. Your use of those services is governed by their terms and policies. We are not responsible for third-party availability, accuracy, or conduct.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR COMPATIBLE WITH ANY PARTICULAR GAME CLIENT VERSION OR UPDATE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOVEX LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, GAME ACCOUNTS, VIRTUAL ITEMS, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO KOVEX FOR THE SERVICE IN THE THIRTY (30) DAYS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100), IF YOU HAVE NOT PAID ANYTHING.

You will defend, indemnify, and hold harmless Kovex LLC and its personnel from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your game accounts, your content, or your violation of these Terms or applicable law.

• You may stop using the Service at any time.
• We may suspend or terminate access at any time, with or without notice, including for violation of these Terms, abuse, fraud, chargebacks, or conduct that harms the Service or other users.
• Upon termination, your right to use the Service ends immediately. We may delete stored data associated with your account, subject to legal retention requirements.
• Fees already paid are non-refundable except where required by law or expressly stated otherwise.

These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the state and federal courts located in New Mexico for disputes arising out of or relating to these Terms or the Service, except where prohibited by law.

We may update these Terms from time to time. We will post the updated Terms on this page and revise the “Last updated” date. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

These Terms, together with the Privacy Policy, are the entire agreement between you and Kovex regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
